Your Health Secrets Are Maybe-Already on the Internet {Switched.com}

Jun 8th 2008 7:48PM Christine: Maybe patients can bolster privacy by inserting legal terms of access (like an end-user license agreement) into the content of their electronic medical records. The terms could set binding rules for who may view data and when. The idea is not legal advice, just something to think about. --Ben http://hack-igations.blogspot.com/2008/02/contracts-for-patient-privacy.html

Adobe launches Acrobat 9 and Acrobat.com online office suite {Download Squad}

Jun 2nd 2008 1:34PM Brad: Collaborative software environments like Acrobat.com and Zoho can create oceans of records on business interactions, negotiations and contracts. Those records can be relevant in a lawsuit. An issue businesses will face is whether to preserve those records under their record retention policies. --Ben http://hack-igations.blogspot.com/2008/02/collaboration-e-discovery-and-record.html

Jun 1st 2008 7:08PM Blake:

As businesses increasingly rely on cell phone, text and other instant messages to transact business and support legally-binding contracts (such as auction contracts), they need to retain reliable records of those messages. The good old days where contract records are pieces of paper are going away. --Ben See http://hack-igations.blogspot.com/2007/11/instant-message-retention-e-discovery.html

Comcast Wants to Put Cameras In Your Home {Switched.com}

Mar 26th 2008 3:41PM Legally speaking, you and Comcast might be wise to post notices in your living room to warn strangers that a surveillance camera is in use. http://hack-igations.blogspot.com/2008/03/robots-as-keepers-of-legal-records.html

Thieves Snag 4.2 Million Credit Card Numbers from Supermarket Chain {Switched.com}

Mar 18th 2008 1:42PM Spectacular announcements about massive data security breaches do the public little good. The implication of these announcements is that some data (i.e., that which are the subject of the announcements) are more exposed than other data. As a practical matter that is false. All personally identifiable data are more or less exposed all the time. And successful exploitation of that data by an identity thief requires a lot of work and luck. Socially responsible data-holders should set a high threshold of proof before concluding that a "data security compromise" worthy of announcement has occurred for any given unit of data. http://hack-igations.blogspot.com/2007/09/definition-of-data-security-breach.html (Data-holders should of course consult their attorneys.)
