She's a PhD. for heaven's sake! Sorry, but she should have known better. However, I would think that her 1st amendment rights would protect her in this case unless her contract specifically prohibits what she did.

Why is it that people who have never read the first amendment always use it as an argument in cases like this? No one is saying that she doesn't have the right to say what she said; it's just that there are consequences. The first amendment is about the government curtailing free speech. Why don't you test your first amendment rights by going up to your boss and telling him/her that you dislike him/her, dislike your colleagues/customers, and that your job sucks. Let's see how long you last. Sadly, this woman is an example book smart, but completely lacking in common sense. She could be a very nice person, but I would want someone brighter to teach my children....

You need to understand that her 1st amendment rights were not violated. You do have the right to voice your opinion, but you are not protected from the reaction to your opinion other than from the government. If one of my employees would express to me that in their opionion, I am stupid, dishonest or that the service we offer is garbage, I have the right to let them go. It is called insubordination and in most states is justified termination. The 1st amendment is not without limitations, such as the old example of yelling fire in a crowded theatre, or walking down the street calling people vile names. Try that sometime and see how far your stance takes you.

If it's a private high school she's screwed but if it's a public high school it's run by the government so she could have a 1st Amendment case.
