No, it's not protected free speech. However, it's not libel unless it's not true. If someone puts up his opinion or an incident that happened to them, there is no case for the towing company. If you say, they're crooks then that might be libel. Actually with their record you might be able to convice the judge they are crooks. Then it would be true. Sounds like this is a case of abuse of prosecution. It's a good thing it wasn't me, I would counter sue in a second. But then if they did something to me I'd sue just for that. Been there, done that. In fact I have to open up a couple more soon. Enjoy doing it.
