Matthew White, of Sacramento, California, has found himself in a rather unfortunate situation; he's been accused of downloading child
pornography. On the advice of his public defender, White is pleading guilty in hopes of cutting his potential 20-year sentence down to three and a half years. After serving his time, White will have to serve 10 years of probation and register as a sex offender.
What makes this unfortunate is that the 22-year-old White claims he downloaded the child pornography on accident from the file-sharing service
LimeWire. According to White, he was attempting to download a 'Girls Gone Wild' video two years ago, but when he opened the files, instead discovered images of underage girls. White claims to have immediately deleted the images and never looked back -- at least until the
FBI showed up at his door a year later.
Last year, agents showed up at the door and asked if they could examine the family's computer. The Whites agreed, and, at least at first, the agents found nothing incriminating. Not satisfied with their preliminary search, the agents used software to dig deep into the hard drive and to recover deleted files. There, they recovered the illegal images. Matt told his
local CBS News affiliate:
"I asked them, 'Where did you get that? I don't remember that.' I asked them, 'Could I access that if I wanted to?' They said no."
Despite the admission by the FBI that he could not access the files even if he wanted to, Matt was still arrested. Quick
Google searches, conducted by CBS and ourselves, revealed plenty of complaints from LimeWire users of accidentally downloading child pornography disguised as more innocuous files.
In the event you ever accidentally download child pornography, the FBI advises you to immediately notify it. The Bureau admits that there is a chance your computer would be confiscated, but when your other option is facing 20 years in prison, that seems like a small price to pay. [From:

Always Turn Off Stolen GPS Units
It was only a matter of time before some numbskull criminal stole a GPS-equipped car or phone, but we didn't expect someone to steal live GPS units. A group of crooks in Lindenhurst, NY swiped 14 functioning GPS devices from the Town of Babylon Public Works. Understandably, authorities had no trouble tracking them down.
Security Cam Catches Tattooed Thief
We're not going to pass judgement on the type of tattoo you get, but you might want to think about what it says before you start getting into crime. Aaron Evans, a 21-year-old U.K. repeat offender, was caught stealing a car's GPS unit because the nearby CCTV captured the tattoo on his neck. It revealed his birthday and name...
Laptop Auto-Uploads Photo of Thief to the Web
This guy may be the unluckiest thief ever. Several laptops disappeared from a Vancouver, BC company; fortunately, one particular laptop was loaded with software that snapped photos when opened. The images of this guy were uploaded to Flickr. As a result, the man became a mini-Internet sensation, and he turned himself in, claiming he bought the laptop from a friend, at a local police station.
Things Not to Do After Stealing a Cell Phone
Gary Walker, an Ohio resident, stole a woman's phone while she had temporarily stepped out of her car to check a street sign. He proceeded to snap a shot of himself with the hot phone's camera. Later, when the victim went online and downloaded her data to transfer it to a new phone, Gary's mug popped up. The rest, as they say, is history.

Girl Recovers Stolen Mac By Remotely Activating Its Webcam
A White Plains, New York girl was the victim of burglary; over $5,000 worth of electronics, including iPods, a flatscreen TV, and a new Macintosh computer were stolen. A few days later, a friend noticed that the burglary victim appeared to be online, but called her to make sure. Because the stolen Mac was running Back to My Mac, the victim was able to log into the computer remotely and snap a picture of the thief. Turns out the thieves were "friends" who had visited the victim's apartment several weeks earlier.
Teen Arrested After Bragging About Arson on Security Cameras
A pregnant Los Angeles teen was arrested earlier after allegedly starting seven fires near her home. 19-year-old Amanda Gessner was caught after convenience store cameras caught her chanting, "The fire company is gonna be
mad at me!" She was certainly right about that!

An upstate New York man installed a camera in a unisex bathroom. The camera was discovered soon after installation, and police found he'd left a video of himself on the camera. Police are still looking for the man.
Forklift Tricks on YouTube
If you're going to show off your sweet forklift driving skills to your buddies, it's probably best to just do it in person. 20-year-old Australian Matthew Garry Ward uploaded a video of safety-violating forklift tricks to YouTube, and was reported to authorities after a coworker passed the video along to the boss.
Laser Pointer Shenanigans
Remember those time-sucking high school pep rallies where some loser would whip out a laser pointer and temporarily blind people in the bleachers? This 15-year-old genius from California, was arrested after shining his laser beam at a police helicopter.

This young man isn't getting good advice from the public defender. He needs a different attorney. Isn't there a defending attorney out there that will step up and do some pro bono work?
kimDec 7th 2009 11:42PM
right if they had that much of a problem with him downloading it, that would have went after him when it happened, not a year later. but i guess we can thank the shit assed government for using our tax money "EVENTUALLY" to keep kids safe.
StacyDec 7th 2009 11:42PM
I just want to tell him to keep fighting, my cousin is serving 17.5 yr for the same exact thing, He pled not guilty and received 5 yrs for perjury, He is an all American boy with no prior criminal record, he was about to join the marines, he had received a medal from our city for saving an older lady, and this is how our government treats him. Had he been an actual pedophile he would be in and out in a year to pry on more kids just like the actual pedophiles out there. This government is not concerned with the truth, just the numbers they put away. GOD help us all.

I posted earlier that I would pitch in for a good attorney to help this guy. I'm serious....Anyone else who is able to help, let me know. Need more info....Where this guy is being held; who defended him; contact information; etc...I will get the ball rolling myself if I have to.

I feel that the FBI should of checked into this mans story and went after LIMEWIRE
If other people have investigated this website and it happened to them too, then maybe there is somthing illegal goin on there.

IT'S BETTER TO CONVICT ONE INNOCENT PERSON THAN TO LET 10 MEN Guilty Men go free
TedDec 8th 2009 12:52AM
Sammy, since your being biblical then why don't you do as Jesus and serve this guys sentence.
SueDec 8th 2009 12:06AM
Sounds fishy to me. They don't send you to jail just for downloading something (that says nothing about child pornography) and deleting right it away. Must be more to the story. Don't believe everything you read just because you don't like the government. Think!

the problem is people making other people more and more ignorant, and an unsuspecting person gets screwd.

The average sentence for criminals convicted of rape in the United States (and released in 1992) is 117 months. The average time served is 65 months, which equates to 56 percent of the actual sentence served. For crimes of sexual assault, the average sentence is 72 months, and the average time served is 35 months, equating to 49 percent of time served. (Greenfeld, Lawrence A., 1995, "Prison Sentences and Time Served for Violence," page 1, Bureau of Justice Statistics, U.S. Department of Justice, Washington, D.C.)
That's right, fact is a real rapist would go to jail 10 years less than this poor boy... The FBI could be solving real crime instead they are doing shit like this.

Um Sue...yes they do, all the time. read www.justice4matt.com, if the site is still operational. Or, google matt bandy since his story was covered in several news papers and other media.

The Government needs to keep the clients coming to all the massive jails they've built. How else are they going to pay for them?
It's quite a sideline industry they've built up over the years.
As if looking a picture or smoking a plant should ever have been illegal.
Do you really think you are "free"?
Nancy W.Dec 8th 2009 12:27AM
This is supposedly a free country. He should be able to download whatever he wants without having to worry that he will go to prison. If they had reason to suspect he is a pedophile, and if they had found child porn stored on his computer where he could access it, then yeah, bust his ass, but, this could happen to anyone. I have stumbled on porn sites more than once searching for something completely innocent. None of them have been kiddie porn, but, I can see how it could happen.
This guy should NOT plead guilty unless he IS guilty. He should fire the lawyer who advised him to do that. What a nightmare.

Terri,
Jefferson may have said that but the doctrine is that of Sir William Blackstone. It is called the "Blackstone ratio", and sadly it is not being adhered to most anywhere in this country. There is an excellent law review on point, google the phrase "nGuilty Men" and enjoy the read.
TedDec 8th 2009 12:32AM
Come on! This dude should not be punished if NO criminal intent was present. The website company that redirected him to child pornography should be held accountable.
However, (I am a little bit ignorant) if he downloaded it that would seem intentional; yet what he downloaded was not supposed to be child pornograpghy? If a crazy pop up comes up and you X it out is that the same as if it were downloaded? It is still somewhere in your computor!
Can someone explain this computer world to me?
I bet all of us commenting on this matter is being placed in FBI files as I type.
