German Man Fined $2,300 for Racist Text Message

A German man has been fined the equivalent of $2,300 for sending a text message, Reuters reported Friday.
The 28-year-old man, who was unnamed in the article, was found to have sent a text message reading, "By opening this SMS, you have killed a Turk." The message, which was sent last June in the midst of Europe's heated Euro 2008 soccer tournament, continued to call for a "clean" tournament, invoking the language of racial cleansing.
Contending that his client had forwarded the chain message inadvertently, and to only one recipient, the man's lawyer Karl Laible managed to convince the court to drop a charge of "inciting racial hatred," which could have resulted in prison time. Instead, due to the man's motive and intent being unclear, the court fined him 1,800 euros.
As a whole, Turkish immigrants have had a tumultuous experience in Germany, where they make up three-percent of the general population. [From: Reuters Via: Textually.org]
Facebook Crime and Punishment
Blackmail
Sending any personal info or incriminating pictures to someone on Facebook is a huge mistake for many reasons. One of the worst possible outcomes is getting blackmailed for money, sex, or, well, anything these sickos dream up. Really, whether they're using a fake profile or not, it's a horrible idea. Read up on the story of an 18-year-old who blackmailed 31 male classmates after he posed as a girl and asked for nude pictures. That's lesson enough.
Impostors
Sure, it can be harmless to impersonate a celeb online or create a fake profile for a movie character. But seriously, there's a definite line you shouldn't cross when pretending to be someone else and it can lead to dire consequences for you. Maybe it's not as extreme as the Moroccan man who was jailed for 43 days after creating a fake Facebook profile of a prince, but you never know. Just steer clear of it.
Self-Incrimination
Do we really have to explain this? Just look up the shoplifter who posed with her stolen merchandise, the many photos of drunk underage teens, and, most recently, the album featuring a couple who killed and ate an endangered iguana in the Bahamas.
Suicide
Social networking sites has been blamed for a lot of things, fairly and unfairly, but in our opinion, the worst offense has been their indirect involvement in suicides. Obviously, there are a lot of factors responsible in each case, but there does seem to be links between social networking and a rash of suicides, and obviously tehre's the case tragic of Megan Meier, who killed herself after a classmate's mom impersonated a teen boy and harassed her over Myspace.
Murder
We've reported on numerous incidents of people getting in trouble because of their online behavior. Now, people are becoming victims because of what they're doing on the Web too. In England, a man was convicted of murdering his estranged wife after she changed her relationship status to "single." So, be careful of who can see your profile and what you're doing, no matter how harmless it seems.
Nigerian Scammers
Oh, you thought this only happened via poorly worded emails, right? WRONG. Once people got wise to their old ways, these con men are turning to social networking sites for new targets. This time, they're hacking into people's accounts and impersonating them to ask for money, usually with some weird sob story. You can check out a transcript of one of these conversations here.
Cooperation
Even if the law isn't on a case, a victim, his friends, or empathetic strangers might be. Since it's easy to get word out for anything online, people are using blogs, forums, and social networking sites to help track down criminals. In one such case, a vehicle thief was tracked down by a bunch of anonymous car enthusiasts after the victim posted his story on a forum. In the end, they identified the guy through his Facebook profile.

this is rediculious! I cannot believe this is what judicial systems are focusing on. seriously a text that was sent to one other person, a friend of his, who prolly wasnt Turkish. I want to know if he's sitting at a game and he sends a text who the heck 'caught' him sending this text? Shouldnt everyone be watching the game? Im not too sure about Germany's laws and restrictions, but I assume that it has to similar to those in the US. Freedom of speech is a right. There is nothing wrong with someone making a joke via text message. It was private. And further more, you dont see jewish people running around calling people racist for usuing them in every single joke known to man kind. And if one race has the right to complain its them. A look back in history, Jewish people have been judged and tormented from the early days and still are today. But they let it roll off their back. Other peoples oppinions and jokes and nasty slurs dont affect the way they love and live. We could all do with a lesson in letting other idiots be idiots and letting people make a sight out of their selves. It's not our jobs as humans to protect everyone and make everything politically correct. Yes racisim is a big deal... when it comes to killing and inhibiting someones way of life. But this small private text message does neither. (despite what it may say)
I think that this entire world needs to wake up and look in the mirror before they start to judge others... first judge yourselves and when your perfect... feel free to judge others... because no one is perfect no one should be judged.

Your commentary is, essentially, ignorant, and displays a pitiful lack of simple, widely available historical knowledge. Read some history before attempting to make an informed statement on racial matters, and especially on the legal aspects of racism in other nations.

You must be reading a different version of history than me. Jews certainly have not let their persecution roll of their backs. They died being forced to work to death in camps in WWII and forced to walk into "showers"/gas chambers. They had no choice but to be killed in various pogroms and Crusades. Being in a minority and not having power they no more let it roll off their backs than American Blacks enjoyed slavery.
Don't apologize for bad manners, or inciteful behavior in a country with a history it needs to be acutely aware of.

Way to go Germany!!! Maybe we should eneact such a law hear, whether the word is Ni***, HON***,KI**, SPI*, and all the main stream racial word we like to use so well, no matter what the race. The U.S. has freedom of speech and hopefully will continue despite the best efforts of the liberal establishment to enforce their brand of politically correct speech. And if you are really sincere about enforcing a law against the words you don't approve of you would have to agree with me that the first to be fined would be all those rappers who use the N word since they have it recorded for everyone to be offended by it. For sure!! Every and anybody... no eception to the rule. But we can't put it all on rappers....how did they get the word to begin with for them to exploit it. So, we can blame it all on rapper cause it goes much farther than that. We also have to go to every religion that disparge or try to assimilate Jews into Christians. Blacks don't use the N word to offend or terrorize anyone, they took a word that was meant to be derogatory towards their person and turned it around to a term of endearment, so now racist are mad because they are labled racist if they use their own made up racist word towards blacks, but blacks can say it with a smile. Why does that burn racist up? Is it because they can't say it face to face to a black alone,without a lynch mob, without getting an arse whooping? Or is it because they took the power from the word? Angela, how can you say you speak for all blacks? I have read that many blacks find the use of the N word offensive. And to say that it becomes a term of endearment? That is just too much to swallow. I don't see other races or nationalities trying to trivialize a word that was used prior to people being beaten or killed. Angela, please be honest about this. If the word is bad it is bad period. You can't have someone using it and say it is ok and someone else using it and being called a rascist. Will it come down to where we have a color chart to determine if someone is black enough to use the N word and if he is too light colored he becomes a rascist? Do you see how crazy this can get?

OK, let's take a look at that phrase "hide behind my computer racist". So you think you can tell who is a racist just because someone disagrees with you? That is precisely why the discussion of race is this country is going nowhere. I have found that very often as soon as someone disagrees with a person of color the "racist" tag is hung on them. Why don't you deal with the facts and not try to interpret them through a lens that tells you that's racist or he or she is racist. Tell someone what makes it racist and then you really have a discussion. If using the N word is ok with you then I think you have a problem. It is a derogatory word and not a term of endearment. If it is a term of endearment then anyone could and should use it everyday, not just certain people who are selling records and making money off of it. The whole point of this discussion is to have free speech, not the government censored speech of Germany. If it isn't free for everyone than it soon won't be free for anyone.

So what do you mean by the term "I hid behind my computer racist"? Is this what the discussion breaks down to, someone posts and it is assumed that the post is racist if you disagree with it? I think that is why the discussion of race will never get anywhere if people who disagree are hit with the "racist" label. Your post would be more effective if you actually stated what was racist about someone's post instead of just lashing out. Give some specifics or am I right that you feel that to disagree is to be called a racist, either with or without a computer? I just hope that my point is being made that I don't want a government censored right to speech as they have in Germany. I suspect that you and Angela would be happy with the German style censorship.
