Gibson Sues 'Rock Band' Creators, Wal-Mart, and Other Retailers

Legendary guitar company Gibson filed a patent-infringement suit against Viacom and Electronic Arts, the makers of 'Guitar Hero,' alleging that 'Rock Band''s unique controller and gameplay are currently covered by a Gibson patent. This news doesn't come as too much of a surprise. Earlier this month, Gibson alerted Activision that its 'Guitar Hero' game infringes on earlier Gibson patents, despite Gibson's licensing deals with 'Guitar Hero.'
Gibson also went on to file suit against retailers Toys 'R' Us, GameStop, Amazon, Wal-Mart and Kmart in order to halt sales of the hugely popular game. 'Rock Band' has been out for about six months now and the 'Guitar Hero' has been around for years, so we're wondering what took Gibson so long.

glad i got my 2 wireless guitars. Yo preorder your guitar hero areosmith game coming out on june 29th. I ordered mine. there are a ton of awesome songs on it.

Gibson, Fender, Ibanez and Kramer among my favorite instruments depending on the sound one desires during recording, may use a little of each when over dubbing, are all fantastic choices! I for one am so glad somebody is nailing Walmart, the low life scum of the Dept Store chains! Ahh hahahahahahaaha! ROFLMAO You go Gibson! Bust a hole in that cash box baby!

In addition to constantly suing, Gibson has a history of purchasing music-related companies and running them into the ground. Opcode Systems and Oberheim are but two.

Gibson is simply waiting for Walmart and other companies to make money off the Gibson patent, using their own marking costs and business structures. Then they go in and demand a share of the profit. They get free advertising, free marketing, free salesforce. A smart business move. Many companies do this

At least a whisky jug takes some talent to play, Guitar Hero is just a fantasy game. If you really want to be a rock hero, you have to practice. However, some people waste their time playing fantasy video games instead of the real thing.

Leave it to a company like Gibson to do this. I just don't see C.F. Martin doing the same thing. Gibson has always had this "big corporate" attitude abvout their instruments and design.

Sadly, the Gibson company seems to have had to resort to frivolous lawsuits to shore up their sagging sales. For years, the Gibson Les Paul was one of the most prestigious instruments a player could own. There will be no comparisons to Fender instruments here - that would be like comparing milkshakes to lemonades. The Gibson guitars nowadays are not what they once were and horribly overpriced. For a time, retailers were threatening to (and some did) do away with the brand altogether. The Fender Stratocaster, the single most played electric guitar on planet earth, has been copied and replicated in a million different ways, but the Fender people simply smile at the flattery and the continued healthy sales of a quality and affordable instrument.
