Police Accept "Ear-Warming" Excuse From Driver With Cell Phone

Klein claimed that he had a earache that morning and was using the warmth generated by his freshly charged cell phone to ease some of the discomfort. Klein was able to produce an itemized telephone bill proving he had not been using the phone at the time of his arrest, and the court accepted his plea of innocence.
We're still not buying it. Something tells us Klein just hadn't finished dialing yet. But the guy deserves credit for being brazen enough to attempt such a blatantly lame excuse.

If you choose to have 5 kids, run a business, etc. that is no excuse to try to conduct your life from your moving vehicle.

The drivers story is likely true. A cell phone being charged does get very warm. The phone bill does have the times for the calls and duration. Do the math. Also, professional truck drivers have to improvise for many things while driving. I should know. 33+ years doing it.

Stick the phone where your head is... UP YOUR ASS...

The best excuse I ever heard was from a man I stopped for speeding 70 in a 55 zone, he said that his wife was going to get pregnant in 30 minutes and that he wanted to be there at the time. That was a new one to me so I told him to slow down and be careful so he could be there at the time. Let him go and chalked the stop up to Verbal warning.

I think he was listening to his Voice Messages. It does not save as a call made or received. "Warming my ear?" True. That indicates a quick thinker, a good attribute for a truck driver to have.

My favorite excuse for speeding is: "My wife is going to conceive a child and I want to be there when it happens." A cop at traffic school said that actually worked.

that guy is just mad because he didn't think of it

The headline was written by a moron. He had to prove his case in court! Besides, did it ever occur to anyone that it might be the truth? It's just another uninforceable law.

I do all the time its called an important call or should I pull off the side of the road just to make a call can you imagine the congestion it would cause on the side of the highway lets be serious its a simple case of multitasking im pretty sure most of you have mastered the art of chewing gum and walking at the same time come on people its not rocket science and last but not least i see cops on cell phones while drive all the time clearly not work related who is slapping them with tickets? Clearly if you have the opposable digits and cranium capacity to talk while driving i say keep chatting and keep your foot on the gas!

What I saw a couple days ago was golden. About 2 or 3 days ago a copy passed me by on my street with a cell phone in his ear. Of course, I have him the evil eye. I have also been debating on reporting him.

Justbeeazy, you're an accident waiting to happen. Particularly since you seem so arrogant about your "important calls" and your ability to drive and talk on the phone at the same time. Driving is a HUGE responsibility, to yourself and thousands of others. Why take a chance with one more distraction.

If he had the phone to his ear, I doubt he was dialing. I hope I never have any of you people on a jury trying me. Your reasoning skills are a bit suspect.
