Cell Phone Blamed for Train Death
A man in Berkeley, California was struck and killed yesterday while crossing the train tracks on foot. Witnesses say that he was distracted by talking on his cell phone, resulting in the accident. The man stood by the side of two sets of the tracks waiting for one train to cross, then immediately stepped out onto the tracks and was struck by a second train passing in the opposite direction.This sounds disturbingly similar to an incident in Ohio we reported about in August. There, a teen was texting on his cell phone and did the same thing, crossed the tracks behind one train only to step in front of the second. He survived, his injuries far less severe than those apparently suffered by the Berkeley man.
If you're crossing the train tracks, we think it might be a good idea to put down the cell phone, pause that iPod and take your ear-buds out, and close the lid on your Nintendo DS before you take the risk of becoming the next to be featured in a post like this.

When I was a child (back in the dark ages) I had to cross a railroad track everyday to get to and home from school. There were gates at the intersection but that never bothered us kids. We simply went around them and my very supportive older brothers actually taught me how to jump through a train to get to the other side so I didn't have to wait. Stupid? You betcha! But not the fault of a cell phone, the train, or the school. I was lucky and nothing ever happened to me although about 10 years later a young boy doing the exact same thing ended up losing both of his legs. As tragic as these things are they are the fault of the person doing them. It could have been me. Thank God it wasn't. But if it had been me it would have been my own fault for doing something that stupid.

I take exception to that Jay. I happen to BE a teacher. I work with the eceptional children population. I am telling you it is not the schools that have failed the children, it is their parents. Everyday I see children who need discipline more than anything to succeed and where are their parents? Sitting on a couch collecting a check because their kid is "ADHD" or some other garbage. I have seen it again and again, do NOT blame the teachers, who are over-worked and WAY under paid for the job they do.
Some idiot had a cell phone jammed in his ear, so what? If he was DUMB enough to cross the tracks without paying attention, he gets no sympathy from this end. That was just plain dumb.

Just out of curiosity, I have been counting drivers on cell phones while I wait at stop lights. I will be waiting for the left hand turn arrow. I watch the drivers passing from my right making a left turn from their signal. While I'm waiting I observe how many people have a cell phone in their ear. It is always MORE THAN HALF of the drivers. People these days are way too stupid to attempt this trick of driving with a phone in their ear. It is too much for the average dumber-than-dirt American these days. It has to stop. Keep the phone for emergencies only. Otherwise, keep it off the road, even the sidewalk, ESPECIALLY train tracks. Amazing how really stupid people are getting. It just keeps getting worse. What has happened? Is everyone suffering from lead poisioning or something?

I can't tell if people are getting dumber or if cellphones and the like are just helping the ones already dumb. You can HEAR the trains coming. How hard is it to put the phone down for five seconds to look?? Like others many accidents I've nearly been on is when someone was distracted by talking on the phone. Yet these will be the first people that will say they don't get distracted and it was someone else's fault. Back in Florida there was a bad wreck. Three cars with a two dead and several hurt. All because the woman that had caused it was on her cell not paying attention. It's getting crazy

It isn't just the fact that we are being killed due to the distraction of cell phones, But also I understand the rediation received from the transmission can cause cancer. When will they tell us the whole truth? I personally have cut my air time by 90%.

yes im in ohio an recal hearing a story to that it happens people get distrated even waling get hit or hit some one driving cells are great but the users are the well fools ill keep it nice i was flicked off cause some one almost hit me while driving an talking couldnt belive it at a cross walk even at a parking lot

I find it ridiculous that a cell phone is being blamed. The fad of blaming someone and/or something else for someone's actions is out of control. How about him being at fault for simply walking in front of a train? The cell phone didnt push him onto the tracks did it?

It was just a careless accident..cell phone or no cell phone..it's no different than being distracted while listening to the radio in the car or watching tv at home. People have gotten spoiled and careless. Very tragic accident.

cells phone should banned while driving in ALL states. i came within in about 2" of being hit while i was getting luch today.the idiot driver was trying to hold a cell phone between shoulder & ear & drive. the intersection i was attempting to cross had a 4-way RED light & a pedestrian walk signal indicating i could cross. phone-nut did a u-turn and nearly hit me & 2 others legally crossing the intersection. obviously this moron should not even be driving period let alone trying to talk on a cell phone & drive at the same time. unfortunately, no cop was nearby at the time. in this town there is a nice fat fine for failure to yield to pedestrians in the cross walk. 50 bucks PLUS court costs - comes to about 150-200 bucks. dimwit wasn't going very fast so maybe i should have let dimbulb hit me & sued for everything the nitwit owns.

Think about the people that had to clean that mess up. I saw a guy hit by a train once, it looked like piles of chopped meat smoking in the cold weather. Ewwwww.

I commented something earlier on cell phone inappropriate useage elsewhere, but to it seems they are causing more problems than what they intended to do. So throw them out, cancel your contract, you need to make a call there are payphones and your house phone and work phone you can use. Nothing can be more important that one has to use their cell phone and put their life at risk at the same time. I say BAN AND DISPOSE OF ALL CELL PHONES.

Penny: "...it's no different than being distracted by the radio..." what? The radio isn't a match for a hot guy on the other end of a young girl's cell phone. I see young girls whizzing past me with their hair blowing and they are laughing as if they are in their own little world (because they are!) "...or watching tv at home and becoming distracted...". Hello! There is no moving train or 65 mph hour traffic crossing through the path of your living room. Yes, accidents happen at home, but come on, let's admit it. Moving vehicles, buses, trucks, suvs, rush-hour traffic, should demand a driver's full attention. I'm, of course, more worried about the safety of myself, my family, my dear sister with her young children than I am of the complete stranger who is talking endlessly on their phones. I have near misses constantly and the only reason I am alive is because when I drive, I act like hunted prey watching out for the next cell phone junkie who is trying to ram the life out of me!
THERE HAS TO BE A STOP TO IT!!
I URGE ANYONE WHO FEELS THE WAY I DO: THAT CELL PHONE USE WHILE OPERATING A MOTOR VEHICLE SHOULD BE BANNED, PLEASE START BY WRITING A LETTER TO YOUR STATE GOVERNOR WITH THE WISHES THAT THEY PRESENT IT TO CONGRESS.
