Man Fired After GPS Showed He Was Not at Work

Turns out the Board of Education was tracking his movements with a GPS receiver built into his employer-provided cell phone. Over five months, administrators noticed multiple discrepancies between where John should have been, and where the GPS data showed he actually was. In response to the data, an administrative judge suggested the 21 year veteran Halpin get the axe.
Halpin tried to fight the termination, saying he was never informed the phone could be used to track his movements, and questioned the accuracy of the data. Unfortunately for Halpin, this did not convince administrative Judge Tynia Richard, who found him guilty of submitting false time records.

Look, the simple matter is he was found guilty of falsifying official company documents. That can get you fired or worse from any company these days. All the GPS data did was confirm that the document entries were false, it wasn't like they were telling him to be somewhere and then they were tracing him via GPS.
Now, to be fair, on the flip side I believe the proper thing to do from the employer's side would have been to have a talk with him after the first discrepancy, and find out what is going on. And make sure that he knows this isn't tolerated. Then, if he still continues to do this and produces falsified time sheets, then you have your case.

If the employer is paying for 8 hours he deserves 8 hours of time. BUT since the employer is paying you for only 8 hours you should be leaving "the companies" cell phone at work in your locked desk or locker or another secure place designated by the employer. You should not be responisble to take it home or carry it after hours since the employer is not paying for your off the clock time and the employer could easily track you off duty movements just as they track you on duty which could be an invasion of your privacy...if any tracking is done during non-work time hours. Play it safe...leave the company provided cell phone at work.

The managers in the retail office supply/computer store I work in, have not been on time the 6 years I have worked there, they take excessive lunches, and instead of being out on the floor, they spend time in "command central".
I would love these people to get a phone, that monitored their comings and goings.

To Sean and all the other idiots out there, here is something to think about. If you take your car in for repair and it takes 10 hours to fix it, but your bill shows 30 hours of labor, you have no problem paying for an extra 20 hours of "work"? Dam, I wish I had your money.

Well folks keep this in mind not only can a company monitor where and when you go somewhere by your phone's GPS even your PERSONAL PHONE. The Feds. are tracking 24/7 the movemnts of GPS phones and cars equiped with them under the homeland security act. This allegedly is to help 911 respond faster yeah sure it does. Oh yes you cannot disable this function as all phones sold for the last 5 years by law havew this feature.
Land of the Free???? Not anymore welcome to the invisable prison.

This is nothing new. Employees steal from their clients on a large scale, and with no remorse whatsoever. They in fact, condone their actions, with stories about how 'they' made their boss all his money, and they deserve to take naps under shade trees while on the clock. I've seen employees end up 200 miles from where they should be working, and in turn, clocking in hours, while they do things that serve no one but themselves. Hooray for the NYC School Dist for firing this liar. He was a downright thief in my opinion.

You brain dead losers taking up for this bum must be Democrats. Employees screw off on company time and yet let their time card and paycheck be off a few bucks and they are first in the office the next day. It's different when it's THEIR money. Glad he got his ass fired, he knew he was stealing.

As much as I think what HE did was wrong, this is an invasion of privacy. If the company is going to track your movements, it should be required by law to TELL you. I may be doing something AFTER WORK that I don't want everyone knowing, but they'd have every capability to tell if i had that cell phone with me.

The man got fired for lying and falsifying time reports. As he should have. Anyone who pads time on his time card would get fired. And while you are on the clock-- the company is paying for your time. Silly them to expect you to actually work during that time.

I Can't believe some of the comments that defend this knucklehead. The same ones whining about "big brother" would probably do the same as him. If he was where he was supposed to be in the first place, there would not have been a problem Bottom line..he was a lazy slug and was stealing time. Gotta love these ACLU idiots..Oh Oh! This goes out to every person complaining that the guy was stealing, 1st of all it doesn't say how early the guy left maybe it was five minutes, you don't know. Any way if this whiny crap keeps up then eventually all companies will put every position on salary and make you work twice as much, twice as hard, with the same pay. If the guy did his job, did it right, safe, quick, there should be no problem with leaving 5-10 minutes early.

YOU GET PAID FOR THE TIME YOU WORK !! Not to hard to understand. The man LIED, he was cheating on his time sheet in order to receive pay that he had not earned.
My big concern is how in the world does ANY school system afford a GPS for a lying, cheating employee? Spend that money on the children's education.

This was not some job that others are not willing and capable of doing. Hey, if you're Tom Brady and you decide you want to skip out a bit early, they probably can't replace you. If you're working in a Burger King, you better remember you can and will be replacced.
Want the perks of an office job? Want the perks of not having to sign in and out? Earn it - either by moving up the ladder or by being your own boss. Want to avoid the stress of these two career moves and the long hours that normally go along with them? Take a 9 to 5 job (or whatever), punch in and out, and get paid. But don't take one and expect the perks of the other.

The man was stealing time, therefore money, from his employer. Obviously wrong. But he should have been told up front by his employer that he would be tracked. Anyone who disagrees with this isn't quite the 'true American' they may think they are.
